May 2027 is one of the most consequential months of the year for Florida homeowners facing foreclosure. Two overlapping events converge: the annual tax certificate sale season, which begins in late May under Florida Statute 197.432, and the spring peak in foreclosure auction volume. Homeowners who have been delaying decisions face real deadline pressure in May.
This monthly update covers the key events, legal deadlines, and options available to Florida homeowners in May 2027.
Tax Certificate Sale Season: Late May 2027
If your 2026 property taxes are still unpaid, May is the final window before your county holds its annual tax certificate sale. Florida Statute 197.432 requires counties to hold the sale by June 1. Most counties schedule it in the last week of May or the first days of June.
When a tax certificate is sold on your property, the certificate holder earns interest of up to 18% per year and gains lien rights. After two years, they can apply for a tax deed -- a forced sale that runs on its own timeline, separate from and potentially faster than the mortgage foreclosure process.
Your mortgage servicer is typically required to advance property tax payments under your escrow agreement to protect their lien position. But if your loan is in default and your escrow is depleted, the servicer may not advance taxes promptly -- and the certificate may be sold before they do. If you have delinquent taxes and no escrow coverage, verify your county's tax payment status now at your county property appraiser or tax collector website.
Spring Foreclosure Auction Peak
May and June represent the statistical peak of Florida foreclosure auction volume each spring. Foreclosure complaints filed in late summer and fall 2026 -- typically 90 to 180 days after first missed payment -- moved through the judicial foreclosure process over the winter, received summary judgment in February and March 2027, and are now scheduled for auction in May.
If you received a lis pendens in August, September, or October 2026 and have not responded or engaged in loss mitigation, your case may have already progressed to a scheduled sale date. Check your county clerk of courts case management portal immediately to see your case status, any scheduled sale dates, and whether a final judgment has been entered.
CFPB Regulation X: The 37-Day Rule in May 2027
Under CFPB Regulation X (12 CFR 1024.41), your servicer cannot take any action to proceed to a foreclosure sale if you submitted a complete loss mitigation application more than 37 days before the scheduled sale date. For a May 31 auction, your complete application must be submitted by April 24 to trigger this protection.
The key word is "complete." An incomplete application does not start the clock. Your servicer is required to notify you of missing items within 5 business days of receiving your initial submission. Work with a HUD-approved housing counselor to ensure your application is complete before the deadline.
Spring Selling Season: May 2027
May through June is peak home buying season in Florida. Buyer demand is at its seasonal high, days on market are short, and pricing reflects strong competition. Florida homeowners with equity who list in May can realistically close before a June auction date in many markets.
A pre-foreclosure sale in May preserves your credit, stops the foreclosure, and returns any net equity to you. The foreclosure judgment never appears on your credit report. You avoid a potential deficiency judgment that could follow you for years. And you maintain control over the sale process rather than losing your home at auction.
If you owe more than your home is worth, a short salenegotiated in May's strong buyer market still produces a better outcome than a foreclosure auction. The lender accepts the sale proceeds as full or negotiated settlement of the debt, and the credit impact is significantly less than a completed foreclosure.
Loss Mitigation Options in May 2027
Florida homeowners have several non-sale options that remain available in May:
- Loan modification -- permanently restructures your mortgage to an affordable payment based on current income; Fannie Mae Flex Modification and FHA Loss Mitigation waterfall remain in effect for qualifying borrowers
- Forbearance -- temporary pause or reduction in payments for homeowners facing short-term hardship; available even during active foreclosure with servicer cooperation
- Chapter 13 bankruptcy -- automatic stay stops any auction immediately; arrears restructured into 3-to-5-year repayment plan
- Deed in lieu of foreclosure -- voluntary transfer of the property to the lender in exchange for debt cancellation and sometimes relocation assistance
