February 2026 finds Florida in the middle of one of its most active foreclosure periods in years. The post-holiday lis pendens surge that began in January is now progressing into active case management: homeowners are receiving summonses, 20-day answer windows are closing, and servicers are moving cases forward. At the same time, Florida's spring real estate market is beginning to open -- a critical window for homeowners with equity who want to sell before foreclosure is completed.
This update covers the February 2026 foreclosure landscape, the resources still available, and the steps homeowners should take based on where their case stands. For context from the prior month, see the January 2026 monthly update.
Homestead Exemption Deadline: March 1, 2026
The most time-sensitive item for homeowners in February is the March 1 homestead exemption deadline. Florida law requires homeowners to file for the homestead exemption by March 1 of the year in which they want the exemption to apply.
For homeowners already in foreclosure, the homestead exemption matters for several reasons:
- It provides constitutional protection against most forced sales by judgment creditors (though mortgage lenders, the IRS, and qualifying HOA lienholders can still foreclose).
- The Save Our Homes cap limits annual assessed value increases to 3 percent per year, preventing a sudden spike in your property tax bill and escrow payment.
- Loss of homestead status can increase your assessed value to full market value immediately, raising your required escrow payment and making an already-difficult mortgage more expensive.
If you are not certain your homestead exemption is in place, contact your county property appraiser before March 1.
HAF Is Still Open -- Apply Now
The Florida Homeowner Assistance Fund (HAF) continues to accept applications in February 2026, but the program's remaining federal allocation is being drawn down steadily. There is no announced closing date, but the program will close without advance notice when funds are exhausted.
HAF can cover mortgage arrears, property tax delinquencies, homeowner insurance premiums, HOA dues, and in some cases utility arrears. Payments go directly to the servicer, tax collector, or insurance company. Apply at floridahousing.org/HAF or call (877) 519-4443.
For homeowners who have already applied but are awaiting a decision, continue your contact with your servicer in parallel. HAF approval does not automatically pause a foreclosure proceeding -- you may need to inform your servicer of a pending HAF application and request that they hold off on advancing the case. Our HUD counseling guide explains how a HUD counselor can help you coordinate between HAF and your servicer.
Spring Market Opening: A Window for Pre-Foreclosure Sales
February marks the beginning of Florida's spring real estate market, historically the most active selling period in most Florida markets. Buyers who arrived in January are actively shopping, and inventory remains limited in many areas. For homeowners with equity who are considering selling before foreclosure is completed, February and March offer the best combination of buyer demand and time before court deadlines typically tighten in late spring.
A pre-foreclosure sale at market value accomplishes several things:
- It pays off your mortgage and outstanding arrears from the proceeds, stopping the foreclosure without a court judgment on your record.
- It avoids the public foreclosure auction, which can attract less than market value and leave you with no proceeds and potentially a deficiency judgment.
- It preserves the equity you have built, which would otherwise be lost in a completed foreclosure.

Active Foreclosure Cases: What to Do in February 2026
Your best actions in February depend on where your case stands:
- Behind on payments, no complaint filed yet: Contact your servicer immediately. Apply for HAF. Consult with a free HUD counselor. Evaluate whether a loan modification or a pre-foreclosure sale better fits your situation.
- Summons received in January, 20-day window closing: File a written answer immediately, even if it is a pro se answer. Contact a foreclosure defense attorney as soon as possible.
- Active case, no judgment yet: Continue pursuing loss mitigation through your servicer. You may still be able to sell before a judgment is entered.
- Judgment entered, sale date approaching: Reinstatement or redemption may still be available. See our guide on Florida's right of redemption.
February 2026 Florida Real Estate Market Context
Florida home prices remain significantly above pre-pandemic levels in most markets, which means many homeowners in foreclosure still have equity they stand to lose in a completed auction. The spring market opening adds urgency: buyers are active now, but the window to complete a pre-foreclosure sale before court timelines tighten is finite.
For homeowners who owe more than their home is worth, the current market supports short sale approvals in most cases. Lenders approve short sales when the net recovery exceeds what they would net at auction. Our short sale guide covers the full process.
