May 2026 marks a shift in the Florida foreclosure landscape. The spring real estate market peak has passed, snowbird buyers are departing, and Florida circuit courts are processing the backlog of cases that built up through the first quarter. For homeowners who have not yet resolved their foreclosure situation, the window for a strong pre-foreclosure sale is narrowing, and hurricane season begins in just six weeks.
This update covers the May 2026 foreclosure landscape and what steps homeowners should take. For prior months, see the April 2026 monthly update.
Spring Market Closing: Act on Equity Before Summer
Late April and May mark the transition out of Florida's strongest selling season. Snowbird buyers who drove competitive offers in February through April are heading north. Buyer demand drops measurably in June, July, and August as summer heat reduces foot traffic and many Florida buyers focus on back-to-school planning rather than home purchases.
For homeowners with equity who have been considering a pre-foreclosure sale, May is the last good window before the summer slowdown. A home listed in the first two weeks of May can still attract strong spring offers, but the window closes quickly.

Court Dockets in May 2026: Cases Moving to Judgment
Florida circuit courts have been working through their spring dockets. Cases filed in January that went uncontested have largely progressed to default judgment or summary judgment hearings by May. For homeowners who did not respond to a January or February complaint, a final judgment may have already been entered or may be imminent.
If a final judgment has been entered in your case, a foreclosure auction date is typically set within 20 to 35 days. Under Florida Statute 45.0315, you have the right of redemption -- the right to pay off the full judgment amount (plus costs and interest) up to the moment before the auction gavel falls. This is a high bar, but it gives you a window to arrange a sale even after judgment.
See our guide to the Florida right of redemption for details.
Hurricane Season Preparation for Homeowners in Foreclosure
Hurricane season begins June 1. For homeowners in foreclosure, this creates several considerations:
- Insurance: If your homeowner insurance policy has lapsed or been cancelled due to non-payment, your lender has likely force-placed insurance on your property at a higher premium, which increases your escrow shortage and monthly payment. Reinstate your own policy if possible.
- Property condition: Lenders can declare a loan in default for failure to maintain the property. If your home has deferred maintenance, secure it before storm season to avoid additional default triggers.
- Disaster forbearance: In a federally declared disaster area, many servicers offer emergency forbearance programs. If a hurricane strikes your county, contact your servicer immediately and ask about disaster relief options.
Loss Mitigation Options Still Available in May 2026
Even in May, loss mitigation options remain available:
- Loan modification: If you have a documented hardship and regular income, a loan modification may restructure your payment into an affordable amount. The servicer review process takes 30 to 90 days.
- Repayment plan: If your arrears are manageable (typically 6 months or less), a repayment plan allows you to catch up over 6 to 12 months while continuing to make regular payments.
- Short sale: If you owe more than your home is worth, a short sale approved by your lender avoids foreclosure and often includes a deficiency waiver.
- Chapter 13 bankruptcy: For homeowners with regular income, filing Chapter 13 bankruptcy stops foreclosure immediately through the automatic stay and allows arrears to be paid over 3 to 5 years.
