April 2026 is one of the most consequential months of the year for Florida homeowners facing foreclosure. On one side of the ledger, the spring real estate market is at its seasonal peak -- buyer demand is high, inventory is limited, and homes listed in April typically sell faster and closer to asking price than at any other time of year. On the other side, Florida circuit courts are accelerating their foreclosure dockets, moving through the backlog of cases filed in January and February.
For homeowners who have been delaying a decision, April is the month when inaction becomes costly. This update covers where things stand and what to do.
For context from recent prior months, see the March 2026 monthly update and the February 2026 monthly update.
Spring Market Peak: Best Window for Pre-Foreclosure Sales
April is historically Florida's strongest month for real estate activity. Snowbird buyers who arrived in late January are still present and actively shopping. Year-round Florida buyers are competing for a limited inventory that has not yet expanded significantly. This combination of demand and limited supply means distressed homeowners who list in April have the best chance of a fast sale at a price that pays off their mortgage and arrears with proceeds remaining.
A pre-foreclosure sale has several advantages over waiting for the foreclosure to complete:
- No foreclosure judgment appears on the public record, which avoids the most damaging credit consequence.
- Equity in the property is preserved and returned to you as proceeds rather than being absorbed by court costs, attorney fees, and auction discounts.
- You control the timeline, the buyer, and the closing date rather than having the court impose a sale date.

Court Dockets Accelerating: What This Means for Active Cases
Florida circuit courts work through their foreclosure dockets in waves. January brings new filings. February and March bring initial hearings and default motions. April is when summary judgment motions start being heard in earnest for uncontested cases.
If you received a foreclosure complaint in January or February and did not respond, the lender's attorney has likely already moved for a default judgment. If a default has been entered against you, a summary judgment hearing may be imminent. Once a final judgment is entered, your options shrink to:
- Reinstating the loan by paying all arrears and costs before the sale (see Florida's right of redemption)
- Filing a motion to set aside the default, which requires showing excusable neglect and a meritorious defense
- Selling the property before the auction date (still possible unless the judgment prohibits a voluntary sale, which is rare)
Contact a foreclosure defense attorney immediately if you have received a motion for summary judgment or a hearing notice.
Loss Mitigation: What Is Still Available in April 2026
CFPB rules require mortgage servicers to evaluate a complete loss mitigation application before proceeding to a foreclosure sale, regardless of where the case stands in court. This means even if a summary judgment hearing is scheduled, a properly submitted loss mitigation application may pause the proceeding. The key requirements:
- The application must be complete (all requested documents submitted).
- The servicer must acknowledge receipt and evaluate the application before proceeding to a sale.
- If you have already had one loan modification under the same investor in the same delinquency period, some servicers will not evaluate a second application.
Options include repayment plans, forbearance agreements, loan modifications, deed-in-lieu, and short sales. See our loan modification guide for details on the application process and servicer timelines.
What Homeowners Should Do in April 2026
- Behind on payments, no complaint filed: Contact your servicer immediately. Apply for HAF if still open. Consider whether a pre-foreclosure sale at spring market prices makes sense for your situation.
- Active case, no judgment: Pursue loss mitigation in parallel with exploring a pre-foreclosure sale. The spring market is the best window you will have this year.
- Judgment entered, auction date set: Contact a foreclosure defense attorney to explore whether a motion to postpone the sale is possible while you sell or reinstate.
